Title

AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO A REIMBURSEMENT AGREEMENT WITH CITY EMPLOYEE MATTHEW DORAN AND THE DECLARATION OF AN EMERGENCY

Body

WHEREAS, a withholding error was recently discovered as to the monthly health care premium for the above-named City employee, where-in a single person premium has been deducted from the employee's wages as opposed to a family premium when said employee updated his benefit designation to family coverage; and,

 

WHEREAS, said discrepancy occurred from 2014 to 2018 and totals $8,808.50; and,

 

WHEREAS, Mr. Doran understands that he is responsible for paying said sum back to the City of Groveport within one (1) year; and,

 

WHEREAS, to that end, City Council wishes to authorize the City Administrator to enter into a reimbursement agreement with Mr. Doran which will involve the latter forfeiting 304.06  hours of accumulated sick leave to satisfy his obligation to the City; and,

 

WHEREAS, while Council recognizes that pursuant to Groveport Codified Ordinance Section 143.01 employees separating from service from the City receive only 25% of their accumulated sick time, as long as, said separation involves retirement as opposed to resignation, and,

 

WHEREAS, notwithstanding the aforementioned provisions set forth in 143.01, Council is desirous of allowing Mr. Doran to utilize his accumulated sick time to satisfy the stated obligation to prevent any further negative financial impact to a City employee whose withholding information was inadvertently kept at a single premium designation as opposed to a family premium designation and said mistake was unknown to the employee and the City.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1:                     That the Administrator is hereby authorized to enter into a reimbursement agreement with City employee Matthew Doran for repayment of $8,808.50 to the City of Groveport for the unpaid portion of the employee's family health care premium from 2014 to 2018.

 

Section 2:                     That as part of said agreement Council authorizes the Administrator to accept 304.06 hours of sick leave accumulated by Mr. Doran, notwithstanding the limitations set forth in Groveport Codified Ordinance Section 143.01.

 

 

Section 3:                     That this Ordinance be deemed an emergency measure necessary for the preservation of the health, safety, and general welfare of the community as state law mandates that the City take immediate steps to recover any such employee indebtedness; WHEREFORE, this Ordinance shall be in full force and effect after passage by Council and signature of the Mayor.
