A RESOLUTION REGARDING THE NATURE OF SERVICES TO BE PROVIDED TO ± 295.86 ACRES LOCATED IN MADISON TOWNSHIP ON PARCEL NUMBERS 180-000212, 180-000326, 180-000329, 180-000437, 180-000959, AND 180-001486, UPON ANNEXATION OF SAID TRACT TO THE CITY OF GROVEPORT (EBRIGHT INVESTMENT CO., LLC PETITIONER)

WHEREAS, an agent acting on behalf of the property owner - Ebright Investment Co., LLC - has filed a petition for annexation of ± 295.86 acres located in Madison Township on Parcel Numbers 180-000212, 180-000326, 180-000329, 180-000437, 180-000959, and 180-001486 into the City of Groveport; and
WHEREAS, Section 709.03 and 709.31 (B) of the Ohio Revised Code provides that a municipal legislative authority shall, by ordinance or resolution, adopt a statement indicating what services, if any, the municipal corporation will provide to the territory proposed for annexation, upon annexation; and
WHEREAS, the City of Groveport is required to submit this Resolution to the Franklin County Commissioners within 20 days of filing with the Clerk of Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Council of the City of Groveport, pursuant to Section 709.03 and 709.031 (8) states that upon annexation of 295.86 acres, more or less, of land in Madison Township as fully described in the description tiled with the petition for annexation, will provide the following services to the territory annexed:
A. Police - Groveport municipal police service will be available upon annexation with an average response time of five minutes (5 min.) or less. The existing Township police services will also remain in effect, as incorporated Groveport is a part of Madison Township for police protection services.
B. Fire - Fire service will continue through the Madison Township Fire Department, with no changes in response times, since Groveport is part of Madison Township for fire protection services. The current response times are estimated to be five minutes and one second (5 min. 1 sec.) for daytime request and five minutes and fifty seconds (5 min. 50 sec.) for evening and overnight requests.
C. Emergency Medical Services - Emergency Medical Services will continue through Madison Township Fire Department per the above stated conditions and response times.
D. Sanitary Sewer Service - Sanitary sewer service is available via the existing Groveport Sewer Contract with the City of Columbus. The entire tract is located within the existing contract area. Sanitary sewer service will be available to the annexed territory upon extension of and connection to the sanitary sewer system by the owner/petitioner.
E. Water - Water service is available via the existing Groveport Water Contract with the City of Columbus. The entire tract is located within the existing contract area. Extensions, which may be made to the water system within the contract area, could be used to serve the subject tract, upon extension of and connection to the water utility system by owner/petitioner and per the terms of the Water Contract with Columbus.
F. Storm Sewers - To the extent that the annexed territory is currently served by a roadway drainage ditch, no significant impact to the City of Groveport's storm sewer system is expected. The City of Groveport will be able to receive storm water runoff upon completion of necessary site improvements and connections by owner/petitioner subject to normal approval by the City of Groveport's Engineer.
G. Roadway Maintenance - The City of Groveport has the necessary equipment and staff to support the repair and maintenance to the public roadway serving the subject tract, including snow and ice removal, and any other activities related to the maintenance of the road.
H. Staffing Impact - The City of Groveport expects to be able to serve the subject tract without significant impact to the existing staffing levels.
Section 2: If this 295.86 acres, more or less, site is annexed, and if the City of Groveport permits uses in the annexed territory that the City of Groveport determines are clearly incompatible with the uses permitted under the current county or township zoning regulations in the adjacent land remaining with the Township, the City of Groveport will require in the zoning ordinance permitting the incompatible uses, that the owner of the annexed territory is to provide a buffer separating the use of the annexed territory and the adjacent land remaining within the Township. For the purpose of this section, "buffer" includes open space; landscaping fences; walls and other structured elements; streets and street right-of-way; bicycle and pedestrian paths; and sidewalks.
Section 3: That for the reasons stated in the preamble hereto, which are made a part hereof, this Resolution shall take effect and be in full force from and after the earliest period allowed by law.
