Title

AN ORDINANCE AUTHORIZING AND DIRECTING THE ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH A REGIONAL COUNCIL OF GOVERNMENTS/REGIONAL INCOME TAX AGENCY (RITA) FOR THE PURPOSE OF ADMINISTRATION AND COLLECTION OF MUNICIPAL INCOME TAX IN THE CITY OF GROVEPORT AND THE DECLARATION OF AN EMERGENCY

Body

WHEREAS, the City of Groveport desires to contract with an outside agency to administer the income tax laws of the City of Groveport and to act as its agent in the collection of said taxes; and,

 

WHEREAS, the City is in receipt of a proposal from RITA for the administration of these services; and,

 

WHEREAS, Council desires to authorize the Administrator to enter into an agreement with RITA.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1:  That the Administrator is hereby authorized and directed to execute, on behalf of the City of Groveport, an agreement with RITA for the administration and collection of the City of  Groveport’s Income Tax beginning on January 1, 2019.

 

Section 2:  That pursuant to Section III of the aforementioned agreement, the Director of Finance, is hereby approved as the representative to the Council of Governments and the Administrator, be and hereby is designated as alternate to the Council of Governments.

 

Section 3:  That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were taken in an open meeting or meetings of this Council and any of its committees that resulted in such formal action, were in meetings open to the public and in full compliance with all legal requirements, including without limitation, those set forth in section 121.22 of the Ohio Revised Code.

 

Section 4:  That for the reasons stated in the preamble hereto which are made a part hereof this Ordinance is hereby declared an emergency measure necessary for the preservation of the health, safety, and general welfare of the community this legislation must be enacted in a timely fashion to assure that the City enter into an agreement with the RITA to administer the income tax laws of Groveport and to act as its agent in the collection of said taxes as Groveport's current collection agency, the City of Columbus, has informed the City that it will no longer act in this capacity effective January 1, 2019; WHEREFORE, this Ordinance shall take effect and be in full force upon passage by Council and signature of the Mayor.
