AN ORDINANCE AMENDING, REVISING AND CHANGING ZONING CLASSIFICATIONS, USE AND USE REGULATIONS IN PART ELEVEN - PLANNING AND ZONING CODE OF THE CODIFIED ORDINANCES OF GROVEPORT, OHIO.
Body
WHEREAS, numerous sections in the Planning and Zoning Code need to be updated or enacted in the interests and preservation of the public health, safety and welfare of the residents and City of Groveport and within the police powers of the City of Groveport as provided by the Constitution of the State of Ohio, the Charter and the Codified Ordinances of the City of Groveport; and
WHEREAS, a member of Council or the Mayor desire to initiate the proposed amendments to the Planning and Zoning Code attached as Exhibit A; and
WHEREAS, pursuant to Groveport Charter Section 4.11, immediately after the first reading of the ordinance or resolution, the presiding officer of Council shall refer this Ordinance to the Planning and Zoning Commission for its written recommendation approved by a majority of the Commission’s members concerning the merits of the Ordinance back to Council within ninety (90) days after the Commission’s receipt of the Ordinance; and
WHEREAS, upon receipt of the written recommendation of the Planning and Zoning Commission, Council shall proceed to consider and hold a public hearing on the proposed zoning amendments as provided in the City Charter and ordinances.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That Part Eleven - Planning and Zoning Code, Title Seven, Supplemental Land Use Regulations, Chapter 1173, Group Housing of the Codified Ordinances of the City of Groveport be amended, according to the attached Exhibit "A" which is incorporated herein.
Section 2: That the following sections and chapters are hereby added, amended or repealed as respectively indicated in Exhibit A attached to this Ordinance. Any summary publication of this Ordinance shall include a complete listing of these sections. Notice of adoption of each new section by reference to its title shall constitute sufficient publication of new matter contained therein.
Section 3: That all previous Ordinances, Resolutions, motions, or parts of Ordinances, Resolutions, or motions for the City of Groveport, in conflict herewith are hereby repealed.
Section 4: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
