AN ORDINANCE DECLARING, DESIGNATING, AND DEDICATING A CERTAIN 0.150-ACRE TRACT OF REAL PROPERTY OWNED BY THE CITY OF GROVEPORT FOR PUBLIC RIGHT-OF-WAY PURPOSES

WHEREAS, the City of Groveport is the owner in fee simple of a certain tract of land containing approximately 0.150 acres, more particularly described in Exhibit A attached hereto and incorporated herein by reference; and
WHEREAS, City Council has determined that it is necessary and in the public interest to formally declare, designate, and dedicate said tract for public right-of-way purposes in order to facilitate the construction, maintenance, operation, repair, and use of public streets, utilities, and related public improvements; and
WHEREAS, City Council finds that the dedication of said property for public right-of-way purposes promotes the public health, safety, and welfare and serves a valid municipal purpose; and
WHEREAS, in conjunction with the Wirt Road Realignment and Municipal Parking Lot Design Project, the dedication of said right-of-way is essential to the successful completion of the Project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, STATE OF OHIO:
Section 1: That the City Council hereby declares and designates the real property owned by the City of Groveport consisting of approximately 0.150 acres, and more particularly described in Exhibit A attached hereto, to be utilized for public right-of-way purposes.
Section 2: That the 0.150-acre tract described in Exhibit A is hereby dedicated and accepted as public right-of-way of the City of Groveport. Such dedication and acceptance shall include the right of the City, its agents, contractors, utility providers, and the general public to use the property for lawful right-of-way purposes, including but not limited to roadway, sidewalk, drainage, utility, and related transportation and public infrastructure purposes.
Section 3: That the City Administrator, Director of Law, and other appropriate City officials are hereby authorized and directed to take all actions necessary to implement this ordinance, including the execution and recording of any maps, plats, legal descriptions, affidavits, or other documents necessary to formally establish the right-of-way.
Section 4: That the legal description and survey depiction of the property dedicated by this ordinance, attached hereto as Exhibit A, are hereby approved and incorporated into this ordinance as if fully rewritten herein.
Section5: That this ordinance shall take effect and be in force at the earliest time permitted by law.
