AN ORDINANCE GRANTING A VARIANCE TO MOOSE LODGE 1245 AS TO THE PERMITTED USES IN THE ESTABLISHED ZONING DISTRICT FOR THE PROPERTY LOCATED AT 220 MAIN STREET, CURRENTLY ZONED PLANNED SHOPPING CENTER (PSC) AND FURTHER GRANTING ANY NECESSARY AREA VARIANCES IN CONJUNCTION THEREWITH

WHEREAS, pursuant to Section 1137.03(a)(1) and (a) (2)of the City of Groveport Zoning Ordinance, Council may grant a variance to the permitted uses in an established zoning district for any parcel located in the City of Groveport as well as any necessary area variances.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That applicant, Moose Lodge 1245 is granted a variance as to the permitted uses for the property located at 220 Main Street, currently zoned PSC, and as such, the proposed use to allow for a membership only organization, is hereby permitted pursuant to Section 1137.03(a)(1) of the City of Groveport Zoning Ordinance, provided that the required landscaping barriers are installed at the site in question, and that all outdoor activities cease at 10:00 p.m., with the exception of limited outdoor activities in the to be constructed patio area for smoking.
Section 2: That the aforementioned landscaping barriers with respect to the west side of the premises shall be installed no later than June 1, 2015, and that all remaining buffers are to be installed no later than November 1, 2015.
Section 3: That applicant is further granted the following area variances: That the " E Buffer Yard" along the west side of the premises immediately adjacent to the asphalt area be reduced to 5 feet with the same plantings and fencing required for the "E 15 feet Buffer Yard" option. That the required fencing for the "E Buffer Yard" option, in front of the structure be permitted to exceed 36 inches in heighth.
Section 4: That in granting this variance, this Council has determined that said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Groveport.
Section 5: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
