AN ORDINANCE AMENDING CERTAIN SECTIONS OF PART NINE - STREETS, UTILITIES AND PUBLIC SERVICES CODE OF THE CODIFIED ORDINANCES OF THE CITY OF GROVEPORT AND THE DECLARATION OF AN EMERGENCY

WHEREAS, Groveport operates a sanitary sewer collection system that conveys wastewater to Columbus for treatment pursuant to a long-standing sewer service contract; and
WHEREAS, as a result, development fees described in Chapter 933.13 of the Codified Ordinances of the City of Groveport include both a City of Columbus Sewerage System Capacity Charge - assessed by Columbus for treatment plant capacity and regional system improvements - and a City of Groveport Sewerage System Capacity Charge - assessed locally to fund collection system infrastructure and related capital improvements - shown as a single fee in the rate chart included therein; and
WHEREAS, both the aforementioned Sewerage System Capacity Charges are remitted to and collected by the City of Groveport by applicants seeking the necessary permits and then later separated with the appropriate portion of the funds collected being remitted to the City of Columbus; and
WHEREAS, the City of Columbus has recently taken action to modify their Sewerage System Capacity Charges that will become affective April 1, 2026; and
WHEREAS, it is therefore necessary to amend certain sections of Part Nine - Streets, Utilities and Public Services Code of the Codified Ordinances of the City of Groveport.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That Chapter 925.03 within Part Nine - Streets, Utilities and Public Services, of the Codified Ordinances of the City of Groveport, is hereby amended as shown in the attached Exhibit "A".
Section 2: That Chapter 933.13 within Part Nine - Streets, Utilities and Public Services, of the Codified Ordinances of the City of Groveport, is hereby amended as shown in the attached Exhibit "B".
Section 3: That for the reasons stated in the preamble hereto, which are made a part hereof, this Ordinance is hereby deemed an emergency measure necessary for the preservation of the health, safety, and general welfare of the community to the extent that the City of Groveport will not be able to exact the modified capacity charges prior to the April 1, 2026 implementation date, therefore leaving the City of Groveport at risk for needing to use other revenue sources to pay the City of Columbus the difference in rates unless this legislation is enacted in a timely fashion; WHEREFORE, this legislation shall be in full force and effect from and after passage by Council and signature of the Mayor.
