AN ORDINANCE AMENDING THE ZONING MAP AS TO APPROXIMATELY 23.235 ACRES, MORE OR LESS, OF THE FOLLOWING TRACT OF LAND, LOCATED EAST OF HENDRON ROAD, PARCEL NUMBERS 185-002762 AND 185-002763 OWNED BY, VALERIE J SHOLTES, JAMES SEELIG AND ELISSA A VILLIERS FROM RURAL (R) TO PLANNED HIGH DENSITY RESIDENTIAL (PR-18)

Body

WHEREAS, it would be in the best interest of the citizens of the City of Groveport Ohio, if certain properties were re-zoned.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1: That the tract of land being approximately 23.235 acres, more or less, located east of Hendron Road, Parcel Numbers 185-002762 and 185-002763 be re-zoned from Rural (R) to Planned  (PR-18) pursuant to the attached re-zoning application of petitioner, Redwood USA, LLC and legal description is hereby approved provided that all of the following conditions set forth by the Planning & Zoning Commission are satisfied:

 

1. That a sidewalk be installed along Hendron Road from the north property line to the south property line to connect to the sidewalk installed in front of the senior apartments.

 

2. Major trees being removed for development shall be replaced as per Section 1176.04.

 

3. A Development Agreement be established and entered into between the City and Developer before site development begins, to memorialize requirements of the Developer for the public water main and public sanitary sewer main extension improvements and the Hendron Road lane widening and repaving, as required by the Franklin County Engineer. 

 

4. Site development design shall conform with the City of Groveport requirements, including but not limited to compliance with stormwater management policies and regulations, including requirement for directing site managed storm drainage into an adequate drainage outlet that has positive flow.

 

5.Geometric configuration of site access driveways to / from Hendron Road shall be designed and constructed per requirements of Franklin County Engineer.  

 

6. Existing public sanitary force main: Access by the City to this utility shall be provided with easements with their location and dimension as approved by the City Engineer.  Landscape material placed near this existing utility shall be of a variety that will not impede maintenance of the existing utility and the landscape material shall be planted in an arrangement that maintains a horizontal and vertical separation as required by the City Engineer. Any landscape material removed to maintain the existing utility shall be replaced by the site owner, as directed by the City.

 

7. Sanitary sewers and Water Mains (i.e., Public Utilities) shall be extended along the project site frontage, contemporaneously with or prior to the construction of site improvements.  The design and construction of Public Utilities (i.e., size, depth, pipe and manhole material, specifications and alignment) shall be per the requirements of the City of Groveport and City of Columbus (per service agreement with Columbus). Easements for these Utilities shall be established with site development via Plat or separate instrument, with dimensions approved by the City Engineer.

 

Section 2: That the zoning map shall be amended to reflect Section 1 provided that petitioner conforms with the requirements, conditions and/or recommendations of the Planning & Zoning Commission and/or Council.

 

Section 3: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
