AN ORDINANCE AMENDING THE ZONING MAP AS TO APPROXIMATELY 295 ACRES, MORE OR LESS, OF THE FOLLOWING TRACT OF LAND, LOCATED EAST SIDE OF EBRIGHT ROAD, PARCEL NUMBERS 180-000959, 180-000326, 180-001486, 180-000437, 180-000212 AND 180-000329, OWNED BY EBRIGHT INVESTMENT CO., LLC FROM RURAL (R) TO PLANNED HIGH DENSITY RESIDENTIAL (PR-18).

WHEREAS, it would be in the best interest of the citizens of the City of Groveport Ohio, if certain properties were re-zoned.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the tract of land being approximately 295 acres, more or less, located on the east side of Ebright Road, Parcel Numbers 180-000959, 180-000326, 180-001486, 180-000437, 180-000212 and 180-000329 be re-zoned from Rural (R) to Planned High Density Residential (PR-18) pursuant to the attached legal description and re-zoning application of petitioner Addison Properties, and upon successful annexation of said tracts to the City of Groveport.
Section 2: That the zoning map shall be amended to reflect Section 1 above, provided that all of the conditions set forth by the Planning & Zoning Commission and/or Council are satisfied:
1. The Developer shall complete a Master Drainage Plan for the entirety of Development Area ( all subareas), pursuant to Chapter 935 of the City of Groveport Codified Ordinances. The Master Drainage Plan shall be presented to the City Engineer for review and preliminary drainage approval, which must be secured before detailed design proceeds. The Master Drainage Plan is to include analysis not only of avoiding adverse impact on Sims and Ebright Roads but also including analysis of potentialbenefits to the existing housing on those roads.
2. The Developer shall complete one or more Traffic Impact Studies for the Development and its Subareas and secure approval of each Study from both the City of Groveport and the Franklin County Engineer before engineering design of the first phase of development which may occur in one or more Subareas.
3. The Developer shall enter into one or more Infrastructure Development Agreements with the City of Groveport in support of the Development that shall identify a commitment for design and construction of the following:
a. Roadway and traffic control improvements and pedestrian accommodation necessary to support the project Development including off-site roads and intersections.
b. Water distribution mains, sanitary sewer mains, and storm drainage pipes and conveyance systems to serve and support the Development including off-site water and sewer mains and systems and storm drainage conveyance systems.
c. Stormwater Management basins to support the project Development.
4. All water mains, sanitary sewer mains, and the sanitary sewer pump station and force main, shall be designed and constructed in compliance with the City of Groveport and City of Columbus design and construction materials specifications.
Section 3: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
