Title

AN ORDINANCE AUTHORIZING THE MAYOR AND/OR ADMINISTRATOR TO ENTER INTO A CONTRACT WITH KAREN E. SHEFFER TO SERVE AS MAGISTRATE FOR THE CITY OF GROVEPORT AND THE DECLARATION OF AN EMERGENCY

Body

WHEREAS, Federal District case law currently precludes the Mayor from presiding over Mayor's Court; and,

 

WHEREAS, it is necessary to appoint a magistrate to preside over, Mayor's Court sessions in light of the stated case law in regards to Mayor's Court; and,

 

WHEREAS, Karen E. Sheffer has rendered exemplary service as Mayor's Court Magistrate of the Groveport Mayor's Court; and,

 

WHEREAS, it is necessary for the preservation of the public health, safety, and welfare of the residents of the City of Groveport that Mayor's Court sessions continue to adjudicate cases within the City.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1:  That the Mayor and/or Administrator are hereby authorized to enter into a contract with Karen E. Sheffer to serve as Mayor's Court Magistrate.

 

Section 2:  That for the reasons stated in the preamble hereto which are made a part hereof this Ordinance is hereby declared an emergency measure necessary for the preservation of the health, safety, and general welfare of the community this legislation must be enacted in a timely fashion to assure that the City has a Magistrate immediately available to preside over court proceedings conducted within its jurisdiction; WHEREFORE, this Ordinance shall take effect and be in full force upon passage by Council and signature of the Mayor.
