AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO A ENERGY PROGRAM CONTRACT WITH DYNAMIX AND WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B)

WHEREAS, it is necessary for the Administrator to enter into a contract to upgrade City facilities in order to conserve energy and save on costs associated with its utility consumption.
WHEREAS, Section 9.02(B) of the Groveport City Charter permits the waiving of competitive bidding where the Statutory or Common Law of Ohio does not require competitive bidding; and
WHEREAS, the new energy program involves a single source provider, Dynamix.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into a contract with Dynamix for the purpose of utilizing computer software and services for the purpose of facilitating an upgrade of the City's facilities with respect to its utility consumption and management of the costs associated thereto, thereby waiving competitive bidding pursuant to Section 9.02(B) of the Groveport City Charter, as said contract involves the purchase of services and computer software from a single source provider and this will enable the City to save energy and costs.
Section 2: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
