Title

AN ORDINANCE ACCEPTING AND DEDICATING AS PUBLIC INFRASTRUCTURE THE PUBLIC IMPROVEMENTS IN CONJUNCTION WITH HICKORY GROVE SECTION 3B

Body

WHEREAS, the required public improvements in conjunction with Hickory Grove Section 3B have been completed; and,

 

WHEREAS, inspection of the improvements revealed no deficiencies; and,

 

WHEREAS, the stormwater management pond that was constructed for the Hickory Grove Subdivision will serve as a sediment control basin during home construction for the project, until sediment control from construction is no longer necessary; and,

 

WHEREAS, when home construction in the subdivision has been completed and land areas tributary to the pond are sufficiently stabilized, the City will accept operation and maintenance responsibility.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1That the public improvements in conjunction with the Hickory Grove Section 3B, are hereby accepted and dedicated as a public improvement.

 

Section 2 :  That, despite the acceptance and dedication of the public improvements in Section 1, the City will not accept operation and maintenance responsibility of the stated stormwater management pond until the City Administrator receives and accepts a written memorandum from the City Engineer stating that the construction of the subdivision has been completed and the land areas tributary to said pond are sufficiently stabilized.

 

Section 3 :  That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
