AN ORDINANCE GRANTING A VARIANCE AS TO THE PERMITTED USES IN THE ESTABLISHED ZONING DISTRICT FOR THE PROPERTY LOCATED AT 4500 S HAMILTON RD, PARCEL NUMBERS 185-0002942, 185-002943, 185-001330 AND 185-001331, CURRENTLY ZONED PLANNED INDUSTRIAL PARK (PIP), JIM VOORHIS, APPLICANT, AND THE DECLARATION OF AN EMERGENCY

WHEREAS, pursuant to Section 1193.04(a)(1) of the City of Groveport Zoning Ordinance, Council may grant a variance to the permitted uses in an established zoning district for any parcel located in the City of Groveport, and pursuant to 1193.04(a)(2), may also grant area variances in conjunction with any use variance approved by Council.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

Section 1: That applicant, Jim Voorhis is granted a variance as to the permitted uses for the property located at 4500 S Hamilton Rd, Parcel Numbers 185-0002942, 185-002943, 185-001330 and 185-001331, currently zoned Planned Industrial Park (PIP), and as such, the proposed use to allow the premises to be utilized as a transportation center and alternative school, is hereby permitted pursuant to Section 1193.04(a)(1) of the City of Groveport Zoning Ordinance provided that all of the following conditions set forth by the Planning & Zoning Commission are satisfied:

1. A Traffic Impact Study shall be submitted and City review and acceptance of that Traffic Impact Study shall be completed, before improvements associated with Phase 1 are finished. Moreover, before improvements associated with Phase 2 are started, an Agreement between the City of Groveport and Groveport-Madison School District shall be entered into if the Traffic Impact Study identifies improvements are needed at the SR 317/Firehouse Lane intersection to mitigate for impact brought about by the change in use.
