AN ORDINANCE GRANTING A VARIANCE AS TO THE PERMITTED USES IN THE ESTABLISHED ZONING DISTRICT FOR THE PROPERTY LOCATED AT 2650 LONDON GROVEPORT ROAD, PARCEL NO. 185-001559, CURRENTLY ZONED COMMUNITY SERVICES (CS), MARK SALER, APPLICANT

WHEREAS, pursuant to Section 1137.03(a)(1) of the City of Groveport Zoning Ordinance, Council may grant a variance to the permitted uses in an established zoning district for any parcel located in the City of Groveport, and pursuant to 1137.03(a)(2), may also grant area variances in conjunction with any use variance approved by Council.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That applicant, Mark Saler is granted a variance as to the permitted uses for the property located at 2650 London Groveport Road, Parcel No. 185-001559, currently zoned Community Services (CS), and as such, the proposed use to allow for the expansion of the site to include a fueling station for automobiles, trucks, and semis, is hereby permitted pursuant to Section 1137.03(a)(1) of the City of Groveport Zoning Ordinance provided that all of the conditions set forth by the Planning & Zoning Commission are satisfied.
1. Construction shall not proceed until the Site Re-Development Plan is approved by the City of Groveport Engineering Department including meeting all conditions associated with that approval.
2. Traffic mitigation measures required by either the Franklin County Engineer or ODOT, as an outcome of the final Traffic Impact Study, are committed to and completed with this site redevelopment project.
3. Construction shall not begin until Zoning compliance approval is granted by the Building and Zoning Department.
4. Construction of a 6 foot privacy fence of either wood shadow box or vinyl design satisfactory to the
