AN ORDINANCE APPROVING THE DEVELOPMENT PLAN AS TO APPROXIMATELY 2.53 ACRES, MORE OR LESS, OF THE FOLLOWING TRACTS OF LAND, PARCEL NUMBERS 185-000118, 185-000355, 185-000289, 185-000255, 185-000171, 185-000420, 185-000403 AND 185-000119, OWNED BY THE CITY OF GROVEPORT, PREVIOUSLY REZONED TO SELECT COMMERCIAL PLANNED DISTRICT (SCPD) IN ORDINANCE 11-016 (ADOPTED 5/23/11)

WHEREAS, Council previously approved the rezoning of the above-stated tracts to SCPD in conjunction with the Groveport Town Center Project; and,
WHEREAS, it would be in the best interest of the citizens of the City of Groveport Ohio, if the Development Plan for the aforementioned parcels was approved.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Development Plan, currently on file in the office of the Clerk of Council, for the following tracts of land, being approximately 2.53 acres, more or less, parcel numbers 185-000118, 185-000355, 185-000289, 185-000255, 185-000171, 185-000420, 185-000403 and 185-000119 owned by Petitioner City of Groveport, and previously rezoned to SCPD in Ordinance 11-016 (adopted 5/23/11) is hereby approved.
Section 2: That in approving the stated Development Plan, Council agrees and/or consents to the following:
1) Waiver of traffic access and economic feasibility studies.
2) Ninety-one (91) parking spaces shall be deemed sufficient for the site.
3) Council's approval of items 1 and 2 herein is conditional on developer's acknowledgement that any exhaust system, such as a kitchen exhaust shall be vented on through the roof of the proposed structure(s).
Section 3: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
