AN ORDINANCE AUTHORIZING THE ADMINISTRATOR NEGOTIATE AND ENTER INTO AN AGREEMENT WITH THE OHIO POWER COMPANY (AEP) AND OTHER UTILITY SERVICE PROVIDERS IN CONJUNCTION WITH THE WIRT ROAD REALIGNMENT AND MUNICIPAL PARKING LOT PROJECT, AND THE DECLARATION OF AN EMERGENCY

WHEREAS, the City will be proceeding with construction of the Wirt Road Realignment and Municipal Parking Lot Improvement Project (the "Project") for the purpose of improving safety and traffic flow circulation at the Main Street/Wirt Road/Front Street intersections; and,
WHEREAS, for the Project to proceed, the existing overhead AEP Electrical distribution system and other co-locating utility service providers' systems must relocate to a new position to accommodate space for the Project to proceed in a timely manner; and,
WHEREAS, the City desires to make arrangements with the AEP and other utility service providers to place their systems underground where possible; and,
WHEREAS, to relocate the AEP and utility service providers systems to a new alignment compatible to the City's Project and into the underground setting where possible, AEP (through their subsidiary company "Ohio Power Company"), requires an inter-agency agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to negotiate and enter into an agreement with Ohio Power Company (AEP) and other utility service providers for the purpose of relocating the AEP electrical distribution system and other utility service providers' systems to accommodate space for the improvements associated with the City of Groveport Wirt Road Realignment and Municipal Parking Lot Project.
