AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO PURCHASE ONE (1) 2019 STARCRAFT ALLSTAR SHUTTLE BUS FOR THE TRANSPORTATION DEPARTMENT WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B) AND THE DECLARATION OF AN EMERGENCY

WHEREAS, the City has learned that the two (2) Starcraft Starlight Transit buses it desired to purchase in Ordinance 2021-064 will not be available until late 2023 or early 2024; and,
WHEREAS, the two (2) shuttle buses are immediately necessary to continue the effective and efficient operation of the City's GREAT Program; and,
WHEREAS, Section 9.02 (B) of the Groveport City Charter permits the waiving of competitive bidding where the statutory or common law of Ohio does not require competitive bidding; and,
WHEREAS, Ohio Revised Code Section 735.051 permits the waiving of competitive bidding in the case of a real and present emergency arising in connection with the operation and maintenance of a City Department.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to purchase one (1) 2019 Starcraft Allstar Shuttle bus for use by the Transportation Department thereby waiving competitive bidding pursuant to Section 9.02 (B) of the Groveport City Charter and Ohio Revised Code Section 735.051.
Section 2: That this Ordinance is hereby deemed an emergency measure necessary for the preservation of the health, safety, and general welfare of the community to the extent that this legislation must be enacted in a timely fashion to assure the GREAT Program continues to provide transportation for workers in the City's industrial parks; WHEREFORE, this Ordinance shall be in full force and effect after passage by Council and signature of the Mayor.
