AN ORDINANCE AMENDING GROVEPORT CODIFIED ORDINANCE SECTION 1321.10 TO RESCIND THE DOUBLE PERMIT FEE PROVISION FOR WORK COMMENCED WITHOUT NECESSARY PERMITS AND TO MODIFY THE REINSPECTION FEE

WHEREAS, Section 1321.10(b) of the Codified Ordinances currently requires that where work is commenced prior to obtaining a required permit, “the fees shall be doubled”; and,
WHEREAS, Section 1321.10(c) currently establishes a reinspection fee of $57.50 per additional inspection trip; and,
WHEREAS, the purpose of permit requirements is to ensure compliance with applicable building codes, protect public safety, and preserve property values within the City; and,
WHEREAS, the City Council finds that the automatic doubling of permit fees does not reliably deter unpermitted construction activity and may, in some cases, discourage voluntary compliance after a violation is discovered; and,
WHEREAS, the City Council further finds that enforcement mechanisms that prioritize timely compliance, corrective action, and proportional penalties are more effective in achieving public safety objectives; and,
WHEREAS, it is therefore necessary to amend Section 1321.10 of the Codified Ordinances of the City of Groveport.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That Section 1321.10 of the Codified Ordinances of the City of Groveport is hereby amended as shown in the attached Exhibit "A".
Section 2: That this Ordinance shall take effect and be in force at the earliest period allowed by law.
