AN ORDINANCE GRANTING AN EXTENSION OF TIME FOR A USE VARIANCE GRANTED PREVIOUSLY TO AEP OHIO TRANSMISSION COMPANY, INC. IN ORD. NO. 12-044 FOR PARCEL NO. 185-001294 (ADOPTED 9-24-2012)

WHEREAS, pursuant to Section 1193.04(a) of the City of Groveport Zoning Ordinance, Council granted a temporary use variance to the permitted uses to the above referred parcel.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That Applicant AEP Ohio Transmission Company Inc. is granted an extension of time as to the use variance granted by Ordinance No. 12-044 ( Adopted 9-24-2012) for property located at 4500 S. Hamilton Road ( parcel No. 185-001294), that is, the use for temporary storage of utility poles and all associated construction materials and site restoration materials until 12-31-2015 provided that applicant continues to remediate any road damage caused in the immediate vicinity which is the result of the previously approved and now extended use. To that end, applicant shall submit a maintenance plan setting forth the manner in which the street shall be cared for during the project.
Section 2: That the following area variance be granted in conjunction with the stated extension of said use variance.
1. That the temporary fence currently constructed is permitted to be in the right-of-way of Higgins Boulevard.
2. That the temporary fence is permitted to be in front of the established set back line.
Section 3: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
