AN ORDINANCE ACCEPTING / AUTHORIZING THE ADMINISTRATOR TO ENTER INTO AN EASEMENT AGREEMENT WITH GROVEPORT VENTURE, LLC AND TO ACCEPT THE GRANT OF STORM SEWER EASEMENTS FOR A STORM SEWER SYSTEM LOCATED AT 3755 HAYES ROAD, PARCEL NUMBER 185-003034

WHEREAS, it is necessary that the City of Groveport enter into an easement with Groveport Venture, LLC in order to facilitate access to storm sewers that provide collection of drainage from the Hayes Road right-of-way; and,
WHEREAS, the City of Groveport and Groveport Venture, LLC have now successfully negotiated the essential terms of said easement agreement; and,
WHEREAS, Groveport Venture, LLC desires that Council of the City of Groveport approve and authorize the Administrator to enter into the easement agreement as soon as possible so that storm drainage collection along Hayes Road can be accommodated in a timely fashion
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into an easement agreement with Groveport Venture, LLC according to the terms of said agreement.
Section 2 : That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
