AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO AN ASSIGNMENT AGREEMENT WITH THE FOUNDER'S BEND ASSOCIATION, INC AND INDIANA & OHIO RAILWAY COMPANY AND THE DECLARATION OF AN EMERGENCY

WHEREAS, in order for the City to have immediate access to the public sanitary sewer line under the railway line adjacent to and serving the Founder's Bend Subdivision it is necessary that the City enter into an assignment agreement with the Founder's Bend Association, Inc. and the Indiana & Ohio Railway Company.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into an assignment agreement with the Founder's Bend Association, Inc. and the Indiana & Ohio Railway Company so the City has immediate access to the sanitary sewer line under the railway line adjacent to and serving the Founder's Bend Subdivision for any repair and/or replacement activities.
Section 2: That this Ordinance is hereby deemed an emergency measure necessary for the preservation of the health, safety, and general welfare of the community to the extent that this legislation must be enacted in a timely manner so that the City can have immediate access to the public sanitary sewer line under the railway line adjacent to and serving the Founder's Bend Subdivision for any repair and/or replacement activities; WHEREFORE, this Ordinance shall be in full force and effect from and after the passage by Council and signature of the Mayor.
