Title

AN ORDINANCE RATIFYING THE ADMINISTRATOR'S ENTERING INTO AN AGREEMENT WITH THE CITY OF GROVE CITY FOR THE PURCHASE OF ROAD SALT AND WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B) AND O.R.C.§ 9.48(D) AND THE DECLARATION OF AN EMERGENCY

Body

WHEREAS,  the Administrator previously entered into a contract with the City of Grove City for the purchase of road salt to save the City approximately $9,000.00; and

 

WHEREAS, Section 9.02(B) of the Groveport City Charter permits the waiving of competitive bidding where the Statutory or Common Law of Ohio does not require competitive bidding; and

 

WHEREAS, O.R.C.§ 9.48(D) further allows the City to purchase from another political subdivision that has taken part in a duly authorized state cooperative purchase program and waive competitive bidding under these very circumstances.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1:  That the previous action of the Administrator entering into the stated agreement with the City of Grove City is hereby ratified and competitive bidding is waived  pursuant to Section 9.02(B) of the Groveport City Charter and O.R.C. § 9.48 (D).

 

 

Section 2:  That for the reasons stated in the preamble hereto which are made a part hereof, that this Ordinance shall be considered an emergency measure and is immediately necessary for the preservation of the health, safety, and general welfare of the community as the City will enjoy a substantial savings on its purchase of salt; WHEREFORE, this Ordinance shall take effect and be in full force upon passage by Council and signature of the Mayor.
