Title

AN ORDINANCE CLARIFYING AND/OR DESIGNATING EXEMPT AND NON-EXEMPT POSITIONS IN THE CITY OF GROVEPORT

Body

WHEREAS, the U.S. Department of Labor has released new regulations concerning the exempt status of certain executive, administrative, and professional employees under the Fair Labor Standards Act (FLSA) and, as such, not entitled to overtime pay; and,

 

WHEREAS, because of these new regulations, it is necessary to clarify and/or designate exempt and non-exempt status positions for the City of Groveport.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

 

Section 1:   That the positions set forth in the attached EXHIBIT A which is made a part hereof, are hereby designated as exempt status positions and as such, not entitled to overtime pay pursuant to FLSA regulations. All other positions are hereby designated non-exempt and entitled to overtime pay pursuant to said regulations.

 

Section 2:  That should any City employees' status change from exempt to non-exempt or vice versa pursuant to amendments to the FLSA regulations, the Administrator is hereby authorized, as the City's Personnel Director, to amend Exhibit A accordingly.

 

Section 3:  That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
