AN ORDINANCE AUTHORIZING A MODIFICATION TO THE DEVELOPMENT PLAN FOR 3099 ROHR ROAD, PARCEL NUMBER 185-002965

WHEREAS, Council previously approved the Development Plan for the above-referred development in its approval of the rezoning for this acreage to Planned Industrial Park (PIP) in Ordinance No. 2007-052 (adopted 12/17/2007) and the Modification to the Development Plan in Ordinance No. 14-007 (adopted 3/24/2014); and,
WHEREAS, Council, once again, has no objection to the amendment of said development plan.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Development Plan for 3099 Rohr Road, Parcel Number 185-002965 is hereby modified according to the attached Exhibit "A" which is made a part hereof, provided the following conditions set forth by the Planning & Zoning Commission are satisfied:
a. If at any time site traffic circulation deteriorates due to excessive queuing of vehicles controlled by the guard house and/or security gates such that the vehicle queuing line extends into the Rohr Road right-of-way, and if the City Administrator declares in writing to the owner and tenant that site traffic conditions represent a public safety hazard, controlled access to the security fenced area shall be discontinued within 24-hours of receiving said notice. In this circumstance, the City will notify the owner and/or their tenant, who will then have 30-days to present and implement an alternative plan for City approval that eliminates the unsafe condition.
b. Any future site modification involving the guard house(s), security gates, or similar structures that may affect site traffic circulation is subject to engineering review and approval by the City of Groveport Engineering Department.
Section 2: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
