AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO AN EASEMENT AGREEMENT WITH 6500 PONTIUS ROAD LLC, AKA HILLWOOD DEVELOPMENT COMPANY (HILLWOOD), VACATING AN EXISTING EASEMENT AND GRANTING A NEW EASEMENT TO FACILITATE THE RELOCATION OF A SANITARY SEWER LINE FOR THE 6500 PONTIUS ROAD SITE

WHEREAS, it is necessary that the City of Groveport enter into an easement agreement with Hillwood in order to facilitate the relocation of a sanitary sewer line for the 6500 Pontius Road Development site; and,
WHEREAS, the City of Groveport and Hillwood have now successfully negotiated the essential terms of said easement agreement; and,
WHEREAS, Hillwood desires that the Council of the City of Groveport approve and authorize the Administrator to enter into the easement agreement as soon as possible so that sanitary sewer service will be available to the stated project in a timely fashion.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into an easement agreement with Hillwood according to the terms of said agreement.
Section 2: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
