AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO A CONTRACT WITH DYNAMIX FOR THE REHABILITATION OF THE POLICE BUILDING HVAC SYSTEM AS PART OF THE CITY'S ENERGY PROGRAM AND WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B)

WHEREAS, it is necessary for the Administrator to enter into a contract with Dynamix for the rehabilitation of the Police Building HVAC System as part of the City's Energy Program.
WHEREAS, Section 9.02(B) of the Groveport City Charter permits the waiving of competitive bidding where the Statutory or Common Law of Ohio does not require competitive bidding; and
WHEREAS, the new energy program involves a single source provider, Dynamix.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into a contract with Dynamix for the purpose of rehabilitating the Police Building HVAC System as part of the City's Energy Program, thereby waiving competitive bidding pursuant to Section 9.02(B) of the Groveport City Charter, as said contract involves the purchase of services from a single source provider that will enable the City to conserve energy and save on utility costs.
Section 2: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
