AN ORDINANCE APPROVING THE FINAL PLAT FOR BIXBY ROAD, HICKORY GROVE SECTION 3A, EMH&T, APPLICANT (PARCEL NUMBER 185-001602)

WHEREAS, it is necessary that the final plat for Bixby Road, Hickory Grove Section 3A, EMH&T, Applicant (Parcel Number 185-001602) be accepted.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the final plat for Bixby Road, Hickory Grove Section 3A, (Parcel Number 185-001602) a copy of which is attached hereto and made a part hereof by reference, is hereby approved on the condition that a new Development Agreement (Agreement) for Section 3A is entered into between the Developer and the City before commencement of construction of any infrastructure for Section 3A; said Agreement shall require the Developer to honor its previously agreed financial obligation for Sections 2 and 3, less appropriate credits for the sewer taps; payment of said prior financial commitments of Developer shall include interest at the appropriate judgement rate from the date the obligations became due and unpaid, and, finally, the Final Plat shall meet all of the requirements of Groveport Codified Ordinance Chapter 1191.09.
Section 2: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
