AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO AN EASEMENT AGREEMENT WITH ZELLER-401 FC TIC, LLC AND TO ACCEPT THE GRANT OF A SANITARY SEWER EASEMENT FOR A SANITARY SEWER LOCATED AT 6840 PONTIUS ROAD, PARCEL NUMBER 185-002951

WHEREAS, it is necessary that the City of Groveport enter into an easement agreement with Zeller-401 FC TIC, LLC in order to facilitate access to a sanitary sewer line that provides collection of sewer effluent from the Aireast site; and,
WHEREAS, the City of Groveport and Zeller-401 FC TIC, LLC have now successfully negotiated the essential terms of said easement agreement; and,
WHEREAS, Zeller-401 FC TIC, LLC desires that the Council of the City of Groveport approve and authorize the Administrator to enter into the easement agreement as soon as possible so that sanitary sewer service will be available to the stated project in a timely fashion.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the Administrator is hereby authorized to enter into an easement agreement with Zeller-401 FC TIC, LLC according to the terms of said agreement.
Section 2: That for the reasons stated in the preamble hereto which are made a part hereof, this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
