AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO ENTER INTO A CONTRACT WITH DYNAMIX FOR THE INSTALLATION OF A SUPPLEMENTAL COOLING SYSTEM FOR THE BANQUET ROOM AT THE LINKS AT GROVEPORT AS PART OF THE CITY'S ENERGY PROGRAM AND WAIVING COMPETITIVE BIDDING PURSUANT TO GROVEPORT CITY CHARTER SECTION 9.02(B) AND THE DECLARATION OF AN EMERGENCY
Body
WHEREAS, it is necessary for the Administrator to enter into a contract with Dynamix for the installation of a supplemental cooling system for the banquet room at the Links at Groveport as part of the City's Energy Program.

WHEREAS, Section 9.02(B) of the Groveport City Charter permits the waiving of competitive bidding where the Statutory or Common Law of Ohio does not require competitive bidding; and

WHEREAS, the new energy program involves a single source provider, Dynamix.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:

Section 1: That the Administrator is hereby authorized to enter into a contract with Dynamix for the purpose of installing a supplemental cooling system for the banquet room at the Links at Groveport as part of the City's Energy Program, thereby waiving competitive bidding pursuant to Section 9.02(B) of the Groveport City Charter, as said contract involves the purchase of services from a single source provider that will enable the City to conserve energy and save on utility costs.

Section 2: That this Ordinance is hereby deemed an emergency measure necessary for the preservation of the health, safety, and general welfare of the community to the extent that this legislation must be enacted in a timely fashion so the stated facility has a cooling system in place before the onset of warm weather; WHEREFORE, this Ordinance shall be in full force and effect after passage by Council and signature of the Mayor.
