AN ORDINANCE REMOVING 43.909 ACRES FROM COMMUNITY REINVESTMENT AREA NO. 3, AND ADDING THE SAME 43.909 ACRES OF NEWLY ANNEXED TERRITORY INTO THE CITY OF GROVEPORT

WHEREAS, the City of Groveport previously enacted legislation, Resolution 25-91, describing the boundaries of Community Reinvestment Area No. 3 and further providing for the requirements of eligibility for a tax exemption in the stated area; and,
WHEREAS, the City is desirous of removing 43.909 acres from Community Reinvestment Area No. 3 and replacing said acreage with newly annexed territory to the City; and,
WHEREAS, pursuant to Ohio Revised Code 3735.661(A), said action does not constitute an amendment to Community Reinvestment Area No. 3 as the geographical size of said area is not being expanded, the percentage of a property or category of property's assessed valuation is not being increased, the term of the aforementioned tax exemption is not being increased, the duration of the community reinvestment areas is not being extended nor does the intended action seek to change eligibility requirements for receiving tax exemptions; and,
WHEREAS, in accordance with Ohio Revised Code 3735.661 (B) a modification to Resolution No. 25-91 which removes area from a community reinvestment area does not constitute an amendment to a pre-1994 community reinvestment area.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GROVEPORT, FRANKLIN COUNTY, OHIO, A MAJORITY OF ITS MEMBERS CONCURRING:
Section 1: That the 43.909 acres, as described on the attached Exhibit A, which is made a part hereof, is hereby removed from Community Reinvestment Area No. 3.
Section 2: That 43.909 acres of newly annexed territory to the City of Groveport, as described on the attached Exhibit B, which is made a part hereof, is hereby added to Community Reinvestment Area No. 3.

Section 3: That this Ordinance shall take effect and be in full force from and after the earliest period allowed by law.
